Terms of Service for Painter Promotions

These Terms of Service ("Terms") govern your use of the services provided by Painter Promotions LLC ("Painter Promotions", "we", "us" or "our"), including our website and our SMS messaging program. By using our services or opting in to SMS communications, you agree to these Terms.

1. Services provided

Painter Promotions provides setup and ongoing management of Google Local Services Ads for residential painting companies, an AI answering and text-back service for the leads those ads produce, lead organization and reporting, and customer support during business hours (9:00 AM to 5:00 PM Mountain Time). Optional services we may offer in the future may carry additional fees, which will be agreed in writing before they begin.

2. SMS messaging program

• Content. Messages may confirm scheduled calls or appointments, send reminders, handle rescheduling, follow up on your inquiries and reply to your questions.
• Opt-in. You may consent by checking a box on a website form, by replying with a keyword such as YES to a message from us, or verbally during a call.
• No condition of purchase. Consent to receive SMS messages is not required to purchase any goods or services.
• Frequency and rates. Message frequency varies. Standard message and data rates from your carrier may apply.
• Opt-out and help. Reply STOP at any time to opt out. Reply HELP for assistance.
• Delivery. Painter Promotions and mobile carriers are not responsible for delayed or undelivered messages.
• Privacy. Mobile information is handled under our Privacy Policy and is never shared with third parties for marketing purposes.

3. Age restriction

You must be at least 18 years old to use our services or to consent to SMS communications.

4. Client responsibilities

The client pays Google directly for advertising at the start of each billing period, keeps their calendar and business hours current, answers or returns leads promptly, and supplies the documents Google requires for verification.

5. Fees and payment

Plan fees are published on our pricing page and are billed monthly in advance. Payment is due before services begin for each period. Card payments carry a 4% processing fee. Google's per-lead charges are separate, set by Google, and paid by the client directly to Google.

6. Payment failure

If a payment fails, the client agrees to provide a new payment method within 48 hours. Services may be paused while an invoice remains unpaid.

7. Cancellation

The agreement is month to month. Either party may cancel with written notice at least two business days before the next monthly renewal date. Access to services ends at the close of the current billing period. The client's Local Services Ads account, profile and ad setup remain the client's to keep and run after cancellation.

8. Verification refund

If Google does not verify the client's business for Local Services Ads after the client has supplied the required documents, Painter Promotions refunds the plan fees paid.

9. Dispute resolution

Any dispute arising from these Terms will be resolved through binding arbitration administered by the American Arbitration Association, held in Utah and conducted in English.

10. Governing law

These Terms are governed by the laws of the State of Utah.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the services after a change is posted means you accept the updated Terms.
